S H E A R M A N & S T E R L I N G L L P | 3 7 CONCLUSION For all green hydrogen projects looking to market their products in Europe, it is therefore crucially important to be fully aware of the existing and anticipated regulatory regime at an early stage in project development as these requirements are fundamental to how the project needs to be structured. For the first green hydrogen projects, there is a degree of risk in venturing into unchartered regulatory territory (albeit the overarching political support for green hydrogen appears to be resounding). We are seeing first-mover projects being structured around a conservative regulatory scenario, while retaining as much flexibility as possible to take advantage of the rapidly evolving regulatory landscape.
