We work with our clients to understand rapidly developing digital asset technology, advise on existing and forthcoming tax rules and develop pragmatic solutions. We frequently publish and speak on issues relating to the taxation of digital assets and blockchain-based technology and are recognized as thought leaders in the industry. Our agile, global team provides full coverage throughout the entire deal lifecycle, working side-by-side with our clients to guide them through the process and ensure they stay protected. DeFi, or decentralized finance, is an opportunity with incredible potential to expand financial service provision and access to those services. Our team advises DeFi market participants— including DeFi developers, such as decentralized brokers, exchanges, custodians and lending platforms, and users of DeFi services, such as companies and investors—on the full range of legal, regulatory and commercial issues, helping them capitalize on this opportunity to make a lasting impact on the financial landscape. NFTs NFTs have been issued by businesses in various sectors, exploit gaming opportunities in the metaverse, and to raise brand awareness but they raise new issues under existing legal regimes that vary across jurisdictions. We offer strategic advice on developing and implementing their NFTs by combining a global network of attorneys with a wide range of relevant practices (among them intellectual property licensing, transactions, copyright, trademark, securities and privacy) to help companies take advantage of these new opportunities and attain their strategic goals through the use of NFTs. FINANCIAL RESTRUCTURING AND INSOLVENCY Our Financial Restructuring and Insolvency (FR&I) team has a strong understanding of digital asset transactions and the impact an insolvency or financial restructuring could have on crypto exchanges, customers, and creditors. As more exchanges enter distress and seek bankruptcy protection in this "crypto winter" our FR&I team is well poised to handle the novel issues around crypto bankruptcies. In addition, we have broad experience representing a variety of parties in the crypto, blockchain and digital asset space, including exchanges, power producers, and service providers.. GOVERNMENT INVESTIGATIONS AND ENFORCEMENT ACTIONS The last few years have brought an uptick in enforcement actions involving digital assets. Our multi-disciplinary team has deep experience with the enforcement and regulatory agencies in this space, including DOJ, the SEC, CFTC, OFAC and FinCEN. Our team includes former prosecutors and regulators with firsthand knowledge of how investigations are conducted, which allows us to aid clients in achieving the best possible outcome. We have experience representing digital asset exchanges, trading companies and other market participants before the full range of global financial regulators on issues including token offerings, securities law violations, anti-money laundering, intellectual property, the Foreign Corrupt Practices Act, sanctions and other issues related to digital assets that can result in investigations and enforcement actions.
